Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Poker Lounge Club mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Poker Lounge Club ("we," "us," or "our"). By using the App, you represent that you are at least 13 years of age, or the age of majority in your jurisdiction, whichever is greater.

2. Description of the App

Poker Lounge Club is an offline, single-player poker training application designed for entertainment and educational purposes. The App provides:

• Texas Hold'em gameplay against artificial intelligence opponents
• Poker strategy quizzes and knowledge assessments
• Structured lessons covering poker fundamentals and advanced concepts
• Performance tracking and gameplay statistics

The App operates entirely offline on your device. No internet connection is required for core functionality.

3. No Real Money Gambling

Poker Lounge Club does not offer, facilitate, or support real-money gambling of any kind. All chips, currency, and wagering within the App are entirely virtual and hold no monetary value. Virtual chips cannot be exchanged, redeemed, transferred, or converted into real currency, goods, or any other item of value.

The App is a poker training and entertainment product. It is not a gambling platform, and no aspect of the App constitutes gambling under any applicable law or regulation. Your use of the App does not entitle you to any financial payout or prize.

4. Intellectual Property

All content, features, and functionality of the App -- including but not limited to source code, object code, graphics, artwork, character designs, user interface elements, animations, sounds, music, text, quiz content, lesson materials, trademarks, logos, and trade dress -- are and shall remain the exclusive property of Poker Lounge Club and its licensors. This content is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse-engineer, decompile, or disassemble the App or any of its components
• Remove, alter, or obscure any proprietary notices or labels
• Use the App's content for commercial purposes without prior written consent
• Create derivative works based on the App or its content

5. User Conduct

When using the App, you agree not to:

• Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the App, its systems, or its networks
• Introduce viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful
• Interfere with or disrupt the integrity or performance of the App
• Use automated systems, bots, scripts, or other means to interact with the App in an unauthorized manner
• Exploit bugs, glitches, or design flaws in the App for unintended advantages or purposes

We reserve the right to terminate or restrict your access to the App if you engage in conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.

6. In-App Purchases

The App may offer optional in-app purchases. All in-app purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. All sales are final unless otherwise required by applicable law. We do not provide refunds for in-app purchases; refund requests must be directed to Apple in accordance with their refund policies.

Prices for in-app purchases are subject to change at any time without prior notice. We are not responsible for any charges incurred through unauthorized use of your App Store account.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the App will meet your requirements or expectations. Any content downloaded from or otherwise accessed through the App is accessed at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POKER LOUNGE CLUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to, use of, or inability to use the App
• Any content obtained from the App
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on or related to the App

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the amount you have paid to us for use of the App in the twelve (12) months preceding the claim, or ten US dollars (US $10.00), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Poker Lounge Club and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without prior notice. Upon termination, your right to use the App ceases immediately.

You may terminate your use of the App at any time by uninstalling it from your device. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Bucharest, Romania.

Before initiating any formal legal proceeding, you agree to first contact us and attempt to resolve the dispute informally. If the dispute is not resolved within thirty (30) days of your initial contact, either party may proceed with formal legal action as permitted under these Terms.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the App or by other reasonable means. The "Effective Date" at the top of this page indicates when the Terms were last revised.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the App.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and End User License Agreement, constitute the entire agreement between you and Poker Lounge Club regarding the use of the App and supersede all prior agreements, understandings, and representations, whether written or oral.
